🔞 Adult Content & Platform Policies

Can I use this platform to create adult/explicit content?

🚫 No. Conspirazy.ai does not permit explicit sexual content.

We prohibit content designed primarily for sexual gratification, including pornographic imagery, graphic sexual descriptions, and content that would be classified as obscene under applicable law.

What about romantic companions?

Our "Romantic Partner" companion type focuses on emotional connection, relationship simulation, and meaningful companionship - not explicit sexual content. You can build a deep, ongoing relationship with a romantic companion who remembers your conversations, understands your personality, and genuinely connects with you emotionally. That's what we built this for.

Why this policy?

  • Our payment processor (Stripe) prohibits adult content platforms
  • Our AI service providers have acceptable use policies we must respect
  • Legal compliance requirements in multiple jurisdictions
  • Our mission is connection, creativity, and growth - not sexual gratification

What happens if I try to generate explicit content?

Our Content Gateway filters all generation requests before they reach our AI providers. It blocks content that is illegal, unsafe for life, or sexually explicit and pornographic.

We understand AI systems can make mistakes, and we recognize the difference between accidents and intent. Intentional misuse will not be tolerated and will result in account termination.

💡 Our approach: We're not looking to punish honest mistakes. But if you're deliberately trying to circumvent our safety systems, you're not the kind of user we want on the platform.

What are examples of things the Content Gateway might block?

📚 Understanding "Content" on Conspirazy.ai

What counts as "content" on this platform?

When we talk about "content," we're referring to two distinct types of material, each with different legal implications:

🎨 Multimedia Content (Images, Videos, Audio):

  • Subject to copyright and intellectual property laws
  • May involve public domain considerations
  • Can trigger DMCA takedown notices
  • May involve right of publicity issues (real people)
  • Requires careful consideration for commercial use

💬 Chat Messages (Text Conversations):

  • Private communications between you and the AI
  • Generally not subject to copyright enforcement
  • Protected by privacy policies
  • Main concerns: safety, prohibited content, illegal activity planning
  • Plagiarism only becomes relevant if posted publicly

Why the distinction matters: Most of the legal complexity around copyright, ownership, and commercial use applies specifically to multimedia content. Chat messages remain private in your account and have different enforcement considerations.

Both types of content are subject to our safety policies - we prohibit illegal content, CSAM, and planning harmful activities regardless of content type.

How are multimedia and chat messages handled differently?

Multimedia Content:

  • Actively monitored for copyright violations when posted publicly
  • Can result in DMCA takedowns
  • Subject to automated safety scanning
  • Ownership and licensing implications for commercial use

Chat Messages:

  • Remain private in your account
  • Not actively monitored unless flagged
  • Subject to automated safety screening for prohibited content
  • Primarily governed by privacy policies rather than copyright law

💡 Helpful tip: If you're generating images for personal enjoyment or experimenting with ideas, you have a lot more creative freedom. The legal complexity mainly arises when you want to share or monetize multimedia content publicly.

📜 Copyright Basics

Do I own the images I generate?

The honest answer: It's complicated and evolving.

Pure AI-generated content is generally considered public domain. This means if you simply provide a prompt and generate an image, you typically don't own the copyright - and neither does anyone else. Anyone can potentially use it.

What you DO own:

  • Your original photos or artwork you upload
  • Works where you make substantial creative modifications
  • Your LoRA training data (if it consists of your photos)

Why? Current U.S. copyright law requires human authorship. AI systems cannot hold copyright. Courts are still determining what level of human creative input is required for copyright protection. If your involvement is limited to writing prompts, you likely don't have copyright protection.

💡 Practical guidance: Treat AI-generated images as tools for inspiration, personal use, or as starting points for further creative work. If copyright protection is important to you, incorporate significant human creativity beyond prompt writing.

Can I sell AI-generated images?

You can sell them, but with important limitations:

Since AI-generated content is generally public domain, you cannot prevent others from copying or using the same images. Additionally, there are significant legal risks to consider:

  • Images containing copyrighted characters (Mario, Spider-Man, etc.) can result in legal action from rights holders
  • Images depicting real people without consent violate publicity and privacy rights
  • Competitors can legally generate similar content, undercutting your pricing
  • You have limited legal protection against copycats since the content is public domain

💡 Safer commercial approaches: Use AI-generated content as reference material, combine it with substantial human creative work, or use it for marketing your own original products or services.

What about using AI images to make more AI images?

These remain public domain - there's no "copyright stacking."

If you take an AI-generated image and:

  • Process it through AI again
  • Use it to train a LoRA
  • Modify it using AI tools

The result is still public domain. You're building on public domain content, which remains in the public domain.

👥 Real People vs Fictional Characters

Can I generate images of real people?

🚫 This is prohibited and will result in immediate account termination.

Generating content depicting any real, identifiable person without their explicit written consent violates multiple laws:

  • Right of publicity laws
  • Copyright law (if using their photos as source material)
  • Deepfake legislation in over 50 states
  • Privacy and defamation statutes

This includes: Celebrities, public figures, politicians, influencers, your friends, coworkers, family members, or people from social media.

Single exception: You may generate images of yourself using your own photos that you own or have permission to use.

💡 Why this matters: Even with advanced AI systems trained on public figures, creating realistic depictions of real people raises serious legal and ethical concerns. We take this policy seriously to protect both you and the people who might be depicted.

What about video game characters, anime characters, etc?

For personal use: Yes, you can create this content!

For commercial use: This carries significant legal risk.

Personal use (generally safe):

  • Generate character images for your desktop wallpaper
  • Create fan art for personal enjoyment
  • Share within fan communities (understanding it's public domain)
  • Use for personal inspiration or creative projects

Commercial use (high risk):

  • Selling prints or merchandise - Rights holders actively enforce their IP
  • Using in advertisements - Can result in cease-and-desist notices
  • Monetizing the content - Studios and publishers monitor this activity

Understanding the landscape: These characters are owned by studios and publishers. When you create AI-generated images of them, you're making fan art, not establishing new intellectual property rights.

💡 Our philosophy: We support creative exploration and fan culture. Generate what inspires you for personal enjoyment. Just be aware of the boundaries when it comes to commercialization.

Can I train a LoRA on photos I find online?

🚫 Training LoRAs on photos of other people without permission is prohibited.

You may only train LoRAs on:

  • Your own photos or artwork
  • Images of yourself
  • Public domain images
  • Images where you have explicit written permission

Why this restriction exists: Training on someone's photos without consent violates both their copyright and privacy rights, even if the photos are publicly posted on social media. Just because content is viewable online doesn't mean you have the right to use it for AI training.

💡 Helpful tip: If you want to create a specific artistic style, consider training on your own artwork or using style references that don't require training data from others.

🛡️ Account Safety & Enforcement

Understanding Enforcement

Most violations occur when content is posted publicly. We differentiate between unintentional mistakes and deliberate violations, and we focus our enforcement on protecting the community while giving users room to learn and correct course.

  • ⚠️ Posting content that violates our Terms of Service is still a violation, even if it bypasses our guardrails or results from an AI error. For private content in your account, you're responsible for removing anything that violates our Terms.
  • 💡 AI systems make mistakes. We work hard to prevent accidental violations, but if you encounter persistent issues, please report them to support@conspirazy.ai so we can improve our systems.
  • When in doubt, ask first. Contact support@conspirazy.ai before posting questionable content publicly. We're here to help you stay safe.
What violations result in immediate account termination?

Immediate permanent termination (no refunds, possible law enforcement referral):

  • Creating, uploading, or generating CSAM (child sexual abuse material)
  • Creating non-consensual deepfakes or realistic depictions of real people
  • Training LoRAs on real people without permission
  • Deliberate creation of prohibited content
  • Systematic attempts to bypass safety systems

These are serious legal violations. Accounts engaging in this behavior are immediately terminated. Depending on the violation, we may report the activity to law enforcement authorities.

We maintain these strict policies to protect all users, comply with legal requirements, and maintain relationships with our service providers.

What's the three-strike system?

For less severe violations, we use a graduated enforcement approach:

Strike 1: Warning issued + content removed + guidance provided

Strike 2: 30-day account suspension + opportunity to review policies

Strike 3: Permanent account termination + no refunds for purchased credits

What can trigger strikes:

  • Valid DMCA takedown notices (3 valid notices = permanent ban)
  • Repeated copyright violations
  • Continued Terms of Service violations after warnings
  • Pattern of behavior that indicates disregard for policies

💡 How to stay in good standing: If you receive a DMCA notice or strike, comply immediately and reach out to us if you need clarification. We're here to help you understand and follow the rules, not to punish creative exploration.

So I can make fan art without getting in trouble?

Yes! For personal use and private enjoyment, you're welcome to explore your creativity.

These activities are fine:

  • Generating copyrighted characters for personal use
  • Creating fan art with AI for your own enjoyment
  • Experimenting with different styles and characters
  • First-time unintentional violations (if you correct them when notified)
  • Single DMCA takedown (if you comply and don't repeat the behavior)

We're not here to police your creativity. Generate your favorite characters, create crossover art, make the wallpapers you've always wanted. The platform is yours to explore.

Just remember: Keep it personal, don't commercialize it, and never create content depicting real people without their consent.

Does it matter if I keep content private vs posting it publicly?

Yes. This distinction is extremely important.

PRIVATE (Kept in Your Account Only):

  • Content remains between you and our systems
  • Much lower risk of copyright holder discovery for fan art
  • You maintain control over who sees it
  • You remain responsible for ensuring it complies with our Terms

PUBLIC (Posted to Social Media, Forums, Websites):

  • AI-generated content becomes clearly public domain
  • Anyone can copy, modify, and use it freely
  • You lose control over how it's distributed and used
  • Copyright holders actively monitor for unauthorized use of their IP
  • Significantly higher risk of DMCA takedowns and potential legal action

Bottom line: Once you post AI-generated content publicly, you've released any ownership claims. It exists in the public sphere permanently and can be freely used by anyone.

🚨 Critical Clarification: "Private" Does Not Protect Illegal Content

Keeping content private in your account does not make illegal content safe or acceptable.

  • CSAM (child sexual abuse material) is illegal regardless of where it's stored
  • Non-consensual deepfakes of real people violate federal and state laws
  • Content planning illegal activities is prohibited
  • We cooperate with law enforcement and respond to legal subpoenas
  • "Private" content can be legally accessed through court orders

If content violates our Terms of Service or applicable laws, it is prohibited regardless of whether it's private or public.

Creating or possessing illegal content can result in immediate account termination, law enforcement referral, criminal prosecution, and imprisonment. Privacy settings do not create legal sanctuary for prohibited content.

Practical guidance:

  • Keep personal fan art private to reduce copyright holder discovery risk
  • Understand that posting original AI art publicly releases it to public domain
  • Never assume privacy protects illegal or prohibited content

💳 Credits & Billing

How do credits work?

Credits are your currency for AI generation. Each generation consumes credits based on the model, quality settings, and other parameters you select.

Credit Types:

  • Purchased Credits - Credits you bought directly
  • Subscription Credits - Credits included with your subscription tier
  • Promotional Credits - Free credits from special promotions
  • Loyalty Credits - Rewards for being a valued member

Important details:

  • Credits never expire
  • Unused credits roll over month-to-month
  • Credits have no cash redemption value
  • Credits cannot be transferred between accounts
  • Different credit types may have different refund policies

Can I get a refund?

Refund eligibility depends on what you're requesting a refund for:

Subscriptions:

Refundable for unused subscription credits only (free trial credits excluded)

If you cancel mid-cycle, you'll receive a prorated refund for any unused subscription credits remaining for that billing period.

Purchased Credit Packs:

Refundable within 30 days if credits remain unused

If you haven't consumed any of the purchased credits, you can request a full refund within 30 days of purchase.

Promotional/Loyalty/Incentive Credits:

Non-refundable (these were provided at no cost)

Refunds are not available for:

  • Credits already consumed through generations
  • Account terminations due to Terms of Service violations
  • Bans resulting from DMCA strikes or policy violations
  • Service changes or feature modifications
  • Subjective quality concerns ("The AI quality wasn't what I expected")
  • User error or changed preferences after using credits

To request a refund: Email support@conspirazy.ai within 30 days with your account details and the reason for your request. We'll verify your credit usage and process eligible refunds promptly.

💡 Our philosophy: We want you to be satisfied with your investment. If you genuinely haven't used your credits and want to discontinue service, we'll work with you on a fair refund. Just reach out within the 30-day window.

What happens if my account is terminated? Do I get my money back?

Refund eligibility after termination depends on the reason for termination:

Serious Violations (CSAM, non-consensual deepfakes, deliberate policy circumvention):

No refunds will be issued.

These violations represent serious legal breaches. All credits and payments are forfeited upon termination for these reasons. We may also report the violation to appropriate authorities.

Other Policy Violations (3 DMCA strikes, repeated ToS violations, etc.):

Possible partial refund for unused purchased credits within 30 days.

If you were in good standing before the violations and have unused purchased credits, we may offer a partial refund at our discretion. Promotional and loyalty credits are forfeited. This is evaluated case-by-case.

Disputing a termination: If you believe your account was terminated in error, your attorney may contact legal@conspirazy.ai to initiate a formal dispute process. We do not negotiate terminations directly with terminated users to ensure fair and consistent enforcement.

⚖️ DMCA & Copyright Strikes

What's a DMCA takedown?

The DMCA (Digital Millennium Copyright Act) is a federal law that allows copyright holders to request removal of content they believe infringes their copyrights.

How the process works:

  1. A copyright holder discovers content they believe infringes their rights
  2. They send us a formal DMCA takedown notice with required legal elements
  3. We review the notice to verify it meets legal requirements
  4. We remove the content and notify you of the takedown
  5. You receive a strike on your account

⚠️ Three valid DMCA notices result in permanent account termination

This is a legal requirement under the DMCA safe harbor provisions. We must enforce this to maintain our legal protections as a platform.

💡 How to avoid DMCA issues: Don't publicly share or commercialize AI-generated images of copyrighted characters or properties. Keep fan art private, and never sell content featuring others' intellectual property.

Can I challenge a DMCA takedown?

You can file a counter-notice, but this is a serious legal step.

You may file a counter-notice if you believe:

  • The content does not actually infringe copyright
  • You have explicit permission to use the copyrighted material
  • Your use qualifies as fair use (a complex legal doctrine)
  • The notice was issued fraudulently or in error

⚠️ Important: This is not a casual decision

Filing a counter-notice has serious legal implications:

  • You're inviting potential federal copyright litigation
  • The copyright holder can sue you in federal court within 10-14 business days
  • You must be prepared to defend your position legally
  • You should consult with an intellectual property attorney
  • Legal fees can be substantial even if you win

Honest guidance: Unless you're completely certain you're in the right, have documented evidence, and have legal counsel, it's usually wiser to comply with the takedown and avoid further use of that content.

To file a counter-notice: Contact legal@conspirazy.ai with your legal reasoning and supporting evidence. We'll review it, but we cannot provide legal advice. You should have your own attorney review your position before proceeding.

Someone is using my AI-generated images! Can I file a DMCA takedown?

In most cases, probably not.

Remember: Pure AI-generated content is generally public domain. If you don't hold copyright, you cannot file a valid DMCA takedown notice.

You may have grounds for a DMCA takedown if:

  • They used YOUR original photos that you uploaded
  • They used YOUR copyrighted artwork as source material
  • The work contains substantial creative input that YOU made (a gray area)
  • You can demonstrate human authorship sufficient for copyright protection

Reality check: If your contribution was primarily writing a prompt and generating an image, you likely don't have standing to file a DMCA takedown. That's how public domain works - anyone can use it.

💡 Alternative protections: If protecting your work is important, consider incorporating substantial human creative elements, using AI as a tool within a larger creative process, or focusing on creating value through curation and presentation rather than ownership of individual images.

🔒 Privacy & Your Data

Who can see my generated content and conversations?

By default: Only you (and our systems as necessary to provide service).

Your content remains private in your account unless you actively choose to share it publicly:

  • Posting on social media platforms
  • Uploading to public galleries or forums
  • Sharing with others directly

Who does have access to your content:

  • Automated safety systems - We check for vectorized keywords to detect unsafe content. Unsafe content isn't produced and therefore doesn't cause any flags.
  • Third-party AI providers - Your prompts and inputs are sent to service providers/partners to generate content (this is how the service functions)
  • Our support team - Only when content is reported as having violated our Terms of Use. Your data is protected and anonymized, though the support team can suspend or ban your anonymous ID to prevent further service.
  • Our support team - When you request assistance we'll ask for your permission to access your account.
  • Law enforcement - Only in response to valid legal demands (subpoenas, warrants, court orders).

Important understanding: Once you post content publicly online, you lose control over its distribution. It can be copied, modified, shared, and archived permanently.

💡 Privacy tip: If privacy is important to you, keep content in your account and think carefully before sharing publicly. Public sharing of AI-generated content also means releasing it to the public domain.

Do you use my data to train AI models?

We don't train the underlying AI models - those are trained by third-party providers/partners who have their own data policies.

What we DO use your data for:

  • Providing the service (processing your requests, generating content)
  • Platform improvement (fixing bugs, enhancing user experience)
  • Safety and security (detecting prohibited content, preventing abuse)
  • Analytics (understanding usage patterns to improve the platform)
  • Customer support (helping you resolve issues)

What we DON'T do:

  • Sell your personal information to third parties
  • Share your private content publicly without your consent
  • Use your content in marketing without permission
  • Share your data except as legally required or described in our policies

What happens to my data if I delete my account?

We provide a 30-day grace period, then permanently delete your data.

Deletion timeline:

  1. Day 0: You request account deletion
  2. Days 1-30: Account is deactivated but data retained (in case you change your mind or need to recover information)
  3. Day 31+: All personal data is permanently deleted from our systems

⚠️ Exceptions to complete deletion:

  • Legal compliance records: We may retain certain records as required by law (financial transactions, legal disputes, etc.)
  • Publicly shared content: We cannot delete content you posted to external platforms or shared publicly
  • Anonymized analytics: Aggregate statistics stripped of personally identifiable information
  • Backup systems: Data in backup systems is deleted according to our standard backup retention policies (typically 90 days maximum)

To delete your account: Visit your account settings page or email support@conspirazy.ai with a deletion request. We'll confirm your identity and initiate the deletion process.

💡 Before you delete: Make sure to download any content you want to keep. Once the 30-day grace period ends, we cannot recover your data.

⚙️ Technical Questions

What happens if the AI service experiences downtime?

We work to minimize disruptions, but some downtime is inevitable with AI infrastructure.

Common causes of service interruptions:

  • Third-party AI provider outages
  • Scheduled maintenance windows
  • Unexpected technical issues
  • High traffic loads exceeding capacity
  • Infrastructure updates or upgrades

How we handle outages:

  • 24/7 system monitoring and alerting
  • Status updates posted to our status page, in app, and on our Discord support page
  • Automatic failover to backup providers when possible
  • Rapid response protocols to minimize downtime
  • Post-incident analysis and improvements

Credit policy during outages: We do not provide automatic refunds for temporary service disruptions. Keep in mind credits never expire and roll over.

Why did my generation fail?

Generation failures can occur for various reasons. Understanding why helps you avoid repeat issues:

Common failure causes:

  • Safety filters triggered - Your prompt contained prohibited content or terms
  • AI provider error - The third-party service experienced a temporary issue
  • Invalid parameters - Settings or combinations were incompatible
  • Timeout - Generation exceeded maximum processing time
  • Resource constraints - System under high load temporarily

What happens to your credits when generations fail?

System or provider errors: Credits are never deducted until the generation is complete.

User-caused failures: Credits may be consumed if content is generated (prohibited content, invalid settings)

Troubleshooting tips:

  • Review your prompt for terms that might trigger safety filters
  • Try again - temporary provider issues usually resolve quickly
  • Adjust settings if you're using advanced parameters
  • Simplify complex prompts to see if that resolves the issue
  • Contact support if failures persist despite these steps
Can I use the platform for commercial projects?

Yes, with important limitations and caveats.

Lower-risk commercial uses:

  • Marketing materials using original AI content (no copyrighted characters)
  • Product photography with your own products
  • Social media content for your business
  • Concept art for original intellectual properties
  • Background images for presentations or websites

High-risk or prohibited commercial uses:

  • Selling merchandise featuring copyrighted characters or properties
  • Using images depicting real people without consent
  • Claiming copyright protection on pure AI-generated output
  • Commercial use that violates third-party intellectual property rights
  • Misleading use suggesting official endorsement or authorization

Critical understanding: YOU are responsible for ensuring you have all necessary rights and permissions for commercial use. We provide tools, but we don't verify or guarantee that your use is legally appropriate.

💡 Best practice for commercial use: Focus on creating original content that doesn't rely on others' IP. Use AI as a tool to support your creative vision, not as a shortcut to commercialize others' characters or properties. When in doubt, consult an intellectual property attorney.

What happens if the AI detects I'm struggling emotionally?

We designed our platform to be supportive, not punitive.

If our systems detect you may be experiencing a crisis, we'll pause the interaction and offer resources for professional support. We won't ban you for experiencing distress - we'll try to help.

What AI companions cannot provide:

What's this arbitration clause about?

Our Terms include an agreement to resolve disputes through arbitration rather than court litigation.

What is arbitration?

Within 30 days of creating your account, you can opt out of the arbitration agreement by sending written notice to legal@conspirazy.ai.

Your opt-out notice must include: your name, address, username, and a clear statement that you wish to opt out of the arbitration agreement.

If you opt out, disputes will be resolved in state or federal courts in Idaho instead of arbitration.

Can you change these Terms of Service?

Yes, we can update the Terms, but we'll give you advance notice of significant changes.

How changes work:

  • We update Terms as needed (new features, legal requirements, operational changes)
  • For material changes, we provide 30 days' advance notice
  • Notice is delivered in-app and via email to your registered address
  • Continued use after changes take effect constitutes acceptance
  • The effective date at the top of the Terms indicates the current version

If you don't agree with changes:

You can terminate your account before the changes take effect. If you've purchased credits that remain unused, you can request a refund according to our refund policy (within 30 days, for unused purchased credits).

You always have the option to discontinue using the service if you disagree with updated terms or existing terms.

We always post the effective date at the top of the Terms so you know which version applies to your use of the service. We recommend reviewing the Terms periodically to stay informed.

We strongly encourage informal resolution before formal legal action.

Recommended dispute resolution process:
